ECRE Statement - EU response to displacement from and within Ukraine

ICMC Europe/Share Network supports ECRE’s statement on the EU response to displacement from and within Ukraine in advance of the Justice and Home Affairs Council taking place on 3-4 March 2022.

The triggering of the Temporary Protection Directive (TPD) is without prejudice to the prerogative of Member States to provide more favourable protection status. It should not be excluded that people leaving conflict and violence may be fleeing situations with characteristics and circumstances that qualify them as refugees under the 1951 Convention, or that other protection statuses may be appropriate

The JHR Council must:

  • Adopt the European Commission’s proposal on temporary protection

  • Ensure responses for people fleeing Ukraine who are beyond the scope of temporary protection

  • Provide access at borders

  • Continue and expand preparations in reception and wider asylum systems

  • Provide emergency EU funding

  • Rely on EU agencies to support access to territory and protection

  • Offer solidarity contributions
